I met with a family yesterday where a child wanted to meet with me and her parent to help get a Will and incapacity planning documents in order. Unfortunately, I may not be able to help them. In order to sign a document, a person must have the ability (capacity) to understand the document and understand the consequence of signing that document. I am not medically trained, but as a lawyer, I cannot ethically represent someone when I am unsure that the individual has the understanding to know and desire to engage me for services and also to prepare and sign documents for him or her. Please do not wait with your parents, spouse or loved one has memory issues. Earlier is better.
